Last week, the Biden Administration ordered the U.S. Department of Labor to create an Emergency Temporary Standard through OHSA stating that all employers with more than 100 employees must vaccinate their workforce, or subject to weekly testing. Unsurprisingly, the announcement was followed by a flood of questions about which employers are covered, when the ETS could be enforced and what happens if an employee doesn’t comply.
